TERMS AND CONDITIONS

These Terms of Service outlines how My-Legacy^® Inc ( “My-Legacy”, “We”, “Us”, or “Our”) collects, uses, processes, analyzes and discloses the information you provide collected via www.My-Legacy.ai (the “Site”) and the products, services, mobile applications (Collectively and together with the Site, the “Services”) and how the privacy and security of this information and your account is maintained and managed.  My-Legacy may revise these terms from time to time in future. Please review and understand the Terms of Service (“User Agreement”) and My-Legacy Security Policy when you use My-Legacy services.

By using the Services and the Site, you agree to the terms and conditions of My-Legacy services together with Privacy Policy and the collection, usage, processing, analysis, storage and disclosure by My-Legacy and it’s services providers of the Personal Information that you enter into the Services.  If you don’t agree with this Privacy Policy or the Terms of Service, please do not use the Services.

  Personal Information

• “Personal Information”, in the context of the Privacy Policy is any information that uniquely identifies an individual or otherwise contains personally identifiable information provided by or obtained from any user of the Services. When you use My-Legacy, we may collect some personal information about you, your assignees or beneficiaries or caretakers, such as name, date of birth, telephone number, email address, home address and so on.  In addition, we may also collect additional technical, geolocation information such as device used, MAC address, browser type, IP address, web pages visited and time spent on the My-Legacy website. My-Legacy does not share Personal Information with any third party other than as described in this Privacy Policy
• My-Legacy may use your information, such as your name, email address and date of birth, to service and protect your Account, communicate with you and make you aware of new My-Legacy products and services. This information may also be shared with affiliates to perform administrative and other services for My-Legacy. The technical and other data collected may be used by My-Legacy and its affiliates for analytical purposes, improving the My-Legacy product and customer experience and to protect your Account.
• You can update your personal information by logging-in to your account. If you choose to close your account, you can email to support@My-Legacy.ai.
• “Public Information”, in the context of this Privacy Policy is any personally identifying information the user posted in any public forum through the Services.  Any Public Information posted by the users publicly on the Services is not private, and thus may be used or disclosed by any third party who reads such Public Information without our control and without your knowledge, and search engines may index that information.

Non-Personal Information

• “Non-Personal Information”, in the context of this Privacy Policy, can’t be used to identify a specific user, but may provide information about the interaction with our Services.

Your Account Data

Your Account Content includes the various electronic files and information uploaded and input into your My-Legacy Account. Access and use of your Account Content by you and your sharing partners is controlled by you. My-Legacy contracts with a limited number of third-party service providers to furnish and support My-Legacy services including the storage of your encrypted Account Content. Your Account Content remains encrypted and is not accessed, used or shared by My-Legacy or its third-party service providers for any purpose, except at your direction or as required or permitted by law.

My-Legacy also makes its services available to affiliated and unaffiliated organizations so they, at your request, may make documents and other electronic files available to you and you to them. If you choose to use My-Legacy through your relationship with any of these organizations, My-Legacy may upload electronic files into your Account as instructed by you either directly or as forwarded by that organization. In addition, certain activity information such as the date and time you retrieved an electronic file may be made available to that organization.. At certain times, access to My-Legacy account may not be available due to maintenance or circumstances beyond our control. We may discontinue or modify access your account at any time without prior notice, and you accept any modifications by your continued use of My-Legacy

Data Retention

We retain your personal information and your Account Content for as long as your Account is active, or as needed to provide you services, and as necessary to comply with our legal obligations.

Information Sharing

Your personal information, Account Content and technical and navigational data are only accessed, used and shared in the ways that are described in this Privacy Policy. We may also access and disclose your personal information, Account Content and technical and navigational data as required or permitted by law, such as to comply with a subpoena, or similar legal process, to protect your safety or the safety of others, investigate fraud or respond to a government request.

Protecting Your  Secure Information

The security of your personal information and electronic files is taken very seriously by My-Legacy.  Information that you privately submit through the Services, including your health and medical information, financial information, and legal information and is treated with a commensurate level of security and protection. Only You and your designated assignees, if applicable always retain ownership of your Secure Information. Since your Information and files are encrypted, in the course of our day to day to business operations we can only see the types of Information users submit through the Services on a categorical basis, but not the content or details of such Secure Information. The only time we may have access to or disclose the content or details of your Secure Information is when you or our assignee or your beneficiary has given the requisite permission to share such Secure Information as further described herein, when we are required to by Law, or in other rare circumstances as described in our Privacy Policy https://www.My-Legacy.ai/privacy-policy. 

My-Legacy relies on cloud service providers such as Amazon Web services and/or other providers and depends on the physical, electronic and procedural controls that are provided by the cloud service providers to protect the confidentiality, security and integrity of your Content.  While My-Legacy cannot guarantee absolute security, our efforts include firewall barriers, encryption of your Content while in transit and at rest, authentication procedures, and audit logs, among others, designed to maintain the security of your Content and prevent unauthorized access.

Cookies and Other Online Technologies 

When you access My-Legacy from a computer or other device, we may collect certain information from that device about your browser type, location and Internet Protocol address through cookies or similar technologies.

Cookies are small amounts of data that a website sends to a web browser or application on a visitor’s computer or other device. We use cookies to support the operation of this site and other My-Legacy applications. For example, our session cookies are used for authentication purposes, which are necessary to provide you with the services available through our website and to use certain features such as access to secure areas. We do not link the information we store in cookies to any personal information you submit while on our site or other My-Legacy applications. If you reject cookies, you will not be able to access our website or other My-Legacy applications.

Our third-party service providers also use cookies to collect information that is analyzed in aggregate form to help us understand how our website is being used. Our third-party service providers may also employ clear gifs, images, and scripts that help them better manage content on our site. These third party cookies or similar technologies may be able to recognize your computer or device both when you visit our website or another website serviced by that third party. The use of cookies by our third party service providers is covered by this Privacy Policy. We do have access and control over these cookies.

My-Legacy also uses tools, such as Google Analytics and/or other tools, to help us analyze how you and other visitors use our website and to improve its functionality.  My-Legacy does not provide any personal information about you to such tools and any information collected by such tools is done anonymously without identifying an individual user.  We do not associate information collected by analytics tools with information you may have provided to us. 

User Conduct and Rules on the Platform:

As an agreement to your use of our Services, you agree to use the Services only for  purposes those would comply with these Terms and all associated Laws.  You also agree to respect the privacy and Secure Information of other users of our Services.

You agree not to, and shall not allow anyone else to (a) take any action or (b)modify including but not limited to uploading or otherwise distribute or facilitate the distribution of any Content, including without limitation Your Information or anyone else’s identification documents or sensitive financial information.

Your consent to use of our services also implies that you agree not to  

1.violate or break any of the copyright laws that are associated with our services include but not limited to stealing a trade secret or copying a patent, publishing other user’s information publicly on the website or on any platform or violating right of privacy or other right of any other person or entity that are associated with My-Legacy.

2.Advertise junk, inappropriate content or facilitating social engineering or phishing or spamming the network.

3.Threaten or make any, abusive, harassing, defamatory, or spreading and mis using of other’s sensitive information, posting obscene, vulgar, pornographic, offensive content  or containing or depicts nudity, contains or depicts sexual activity, or is otherwise inappropriate as determined by us in our sole discretion.

4.Post any hate content or content targeting any individual or a group.

As a condition to this agreement You are also agreed not violate or attempt to violate the security of the My-Legacy Services include but not limited to 

1.Accessing  unintended data for the users of the Services;

2. Gaining unauthorized access to an account, server or any other computer system in the network
3.   Attempting to or engaging in,  directly or indirectly, i identifying the vulnerabilities or performing the scanning or test to exploit the systems or networks or bb=reaching any security measures.

4.Attempt to interfere with the function of the Services or the Services’ host or network, including without limitation by uploading or submitting, directly or indirectly, any Content or Your Information that contains software viruses or any other executable codes files,forging any TCP/ IP packet headers or exploiting any network protocols that are designed or has an objective to alter, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of ours or of any third party.

Payments and Billings

a.My-Legacy offers paid services as well as add-on services that can be availed through a payment now or in the future (the “Paid Services”).  Please see our pricing page for a description of the current Paid Services.  Please note that any payment terms presented to you in the process of using or signing up for Paid Services are incorporated into these Terms.

b. We accept credit card payments for use of the Paid Services through our third-party payment processor( the “Payment Processors”. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processors in addition to our Terms.  We are not responsible for the Payment Processors errors.  By choosing to use the Paid Services, you agree to pay us, through the Payment Processors, all charges at the prices then in effect for use of such Paid Services and you authorize us to have your credit card charged by the Payment Processors.  The terms of your payment may be determined by agreements between you and your credit card company. 

 Billing

My-Legacy will charge any fees associated with your use of the Paid Services plus applicable tax to the credit card you provide. By signing up for the Paid Services, you acknowledge that the fees associated with your use of the Paid Services will be automatically billed again on each renewal date thereafter unless and until you cancel your use of and access to the Paid Services. If My-Legacy offers any free trial or other promotion that gives you access to the Paid Services, which must be used within the specified time of the trial. 

(1)If you wish to not to continue using our Paid services You must stop using and cancel your access to Services before the end of the applicable trial period to avoid being charged for the Paid Services.  If you cancel prior to the end of the trial period and are inadvertently charged for a Paid Services, please contact My-Legacy support centre at support@My-Legacy.ai.

(2).If you wish to continue to use our Paid Services, credit card on the file will be billed automatically at the end of each billing period to renew your access to the Paid Services at the price you agreed to pay, unless you tell us well in advance that you want to cancel your access to the Paid Services or use a different credit card. All the fees and charges collected are non refundable. My-Legacy may change the service fees  or add new charges or fees periodically, however we will notify you regarding all the changes in service fees via email that is associated with your account, so it is your responsibility to update your contact and payment information when there are changes.

(3). Valid and current credit card payment information is required to run the services that are associated with your account in a timely manner without suspending or terminating the services. Upon reaching you credit card’s expiration date, we may attempt to contact you to update your payment information via primary email address associated with your Account.  You agree to promptly notify us and your credit card company, if your credit card is cancelled (e.g., for loss or theft) or if you become aware of potential breach of security.  You agree that we (via The Processors ) may continue charging your credit card for the Paid Services unless you have terminated your access to the Paid Services or you tell us to use a different credit card before the end of the applicable billing period.  If any fee is not paid in a timely manner, or () is unable to process your transaction using the credit card information you provided for payment, we reserve the right to suspend or terminate your access to the Paid Services.
  

Cancellation / Termination Terms

If your access is suspended or terminated by us, we reserve the right to permanently destroy your account content. We may suspend or terminate your access at any time if you violate any provisions herein or for any other reason, in our sole discretion, without prior notice to you also this applies in certain situations which are considered to be illegal, offensive, inappropriate, or in contravention of this User Agreement or its intent.

If you wish to terminate your Account, you may do so. If you elect to terminate your Account, we will use reasonable efforts to shut off access to your account and to destroy all copies of your content in accordance with the terms of this User Agreement. If you instruct My-Legacy to delete any specific item of your content, we will use reasonable efforts to delete the selected item(s), You agree that these steps may result in the loss of data or files within your Account and these files or data may not be recovered.

Disclaimer of Warranties, Liability

CLCOR OFFERS SUBSCRIPTIONS TO VARIOUS SERVICES AND REFERS VARIOUS PARTNERS AND THEIR AFFILIATED SERVICES. ALL THE SERVICES ARE MADE AVAILABLE TO YOU ON THIS PLATFORM “AS IS” AND “AS AVAILABLE” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ANY IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, COMPLETENESS, TIMELINESS, USEFULNESS, RELIABILITY OF ANY OPINION, ADVICE OR OTHER CONTENT, ALL OF WHICH ARE EXPRESSLY DISCLAIMED YOUR USE OF THESE SERVICES SHALL BE AT YOUR OWN RISK.My-Legacy AND ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, SHAREHOLDERS,AGENTS,AFFILIATES, SUBSIDIARIES, AND LICENSORS. My-Legacy AND ITS PARTIES  DO NOT WARRANT THAT (1) ALL THESE SERVICES HAVE HIGH AVAILABILITY, WORKS  WITHOUT INTERRUPTION AND ANY DEFECTS AND OR WILL CORRECT THE ERRORS TIMELY  TO MAINTAIN ACCURACY;(2)ANY SERVICE IS FREE FROM SECURITY HACKING OR OTHER SECURITY INTRUSIONS (3) ANY AVAILABLE SOFTWARE OR FIRMWARE COMPONENTS OR CONTENT AT THE SERVICES IS FREE OF VIRUS;(4)THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. My-Legacy DO NOT ENDORSE OR ADVERTISE , GUARANTEE, OR CAN BE HELD RESPONSIBLE FOR ANY PRODUCTS OR SERVICES THAT ARE AVAILABLE TO YOU OVER THE WEBSITE BY THIRD PARTIES. My-Legacy PARTIES CANNOT BE HELD RESPONSIBLE IN ANY WAY FOR MONITORING  TRANSACTIONS BETWEEN YOU AND THIRD PARTY SERVICE PROVIDER’S PRODUCTS OR  SERVICES. AS AN AGREEMENT TO THE USE OF THIS SITE IMPLIES THAT YOU ARE SOLELY RESPONSIBLE FOR ALL THE COMMUNICATIONS AND INTERACTIONS YOU MAKE WITH ANY PERSON. 

LIMITATIONS OF LIABILITY

My-Legacy AND ITS PARTIES do not have special relationship or different executive duties to you. Your agreement to our services release us from all direct and indirect liability for any release of Your Information you provide to My-Legacy , including without limitations on your Secured Information, agreed as only available for release after you are declared dead (the “After Death Sections”) pursuant to our (a) receipt from you of any instructions or permissions authorizing such release to any other person, including without limitation any Read Or Write Access Deputy or (b) compliance with any Laws. 

What to expect: Upon receiving a valid instruction regarding a release of information, My-Legacy executes the instructions that has received and you won’t hold that against us.

Indemnification

As a condition of your acceptance of using  My-Legacy services , you agree  to defend, indemnify and hold us and our affiliates, officers, directors, employees, suppliers, consultants, and agents harmless from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of You or your authorized users breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

My-Legacy has got all rights in retaining to settle, compromise and pay, without your prior consent, any and all claims or causes of action which are brought against us. 

Intellectual Property Rights and Copyright

All information, data, text, photographs, videos, audio clips, written posts and comments, software, scripts, graphics and interactive features generated, provided or otherwise made accessible on or through the Services  any such content will become My-Legacy Property or that of our suppliers or licensors, and are protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws and you grant us the worldwide, perpetual and transferable rights in such Content.  Your consent to the user agreement shall maintain all the copyright notices, information and restrictions contained in any Content that you access through the Services. My-Legacy maintains consistency with Privacy Policies as adopted in accordance with applicable law.  Using, replication, modification, distribution or storage of any Content for purposes other than using our Services expressly prohibited. Without our prior written permission  You shall not sell, license, rent, or otherwise use or exploit any Content for commercial use or in any way that violates any third party right.  

Information can be used on the products and services purposely made available on the Platform provided that You make (1)no modifications to any such information, and do not remove  any proprietary notice language in all copies of such documents,(2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media(3) do not make any additional representations or warranties relating to such documents.

All trademarks and service marks on My-Legacy website belongs to My-Legacy or an affiliate except third-party trademarks and service marks, which are the property of their respective owners.

Third Party Sites and Linking

Links from another Website to My-Legacy must resolve to the top-level homepage of the My-Legacy domain (e.g., www.My-Legacy.ai). In order to avoid confusion if a party does link from another Web site to the My-Legacy top-level homepage, the party’s web site, and the link itself, may not suggest that My-Legacy endorses, sponsors or is affiliated to any of those services.   The inclusion of a link to any Third Party Site does not imply that we endorse or are associated with its operator. Your agreement to the Terms and conditions implies that in  no event My-Legacy shall be liable, directly or indirectly, to anyone for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods or services available on or through any Third Party Site as we do not control third party sites in any way.  We encourage you to review the terms of service and privacy policy of any such Third Party Site. 

Miscellaneous Provisions

This User Agreement is in effect upon your enrollment to the My-Legacy Service and holds valid at all times during your use of our services. Unless otherwise required by law, either you or we may terminate this User Agreement at any time. The termination of this User Agreement will not terminate your obligations or our rights arising under this User Agreement before such termination. All applicable provisions of this User Agreement will survive termination by either you or us, including, without limitation, provisions related to intellectual property, warranty disclaimers, limitations of liability, indemnification, and the miscellaneous provisions also My-Legacy shall not be liable for any failure in executing the obligations under these Terms, where such failure can results from any cause beyond our reasonable control, including without limitation mechanical, electronic or communications failure or degradation.

This User Agreement represents the sole and exclusive agreement between you and My-Legacy and supersedes all previous and contemporaneous written or oral agreements and understandings regarding the subject matter hereof. If a court of competent jurisdiction deems any provision unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
